Chapter: 16 - Restricted Driving Areas

Section: 100 - North Beach and South Beach Permit

A.  A permit to operate a motor vehicle on North Beach and South Beach may be issued by the County Administrative Officer or his or her designee upon proof of the following facts:

1.   The applicant has a current license for commercial or sport fishing or

2.   The applicant, or a person for whom the applicant is a caretaker, is disabled to the extent that the person suffering the disability cannot access the beach without a motor vehicle, and the applicant has medical verification of such disability or

3.   The applicant has filed a written declaration with the County Administrative Officer or his or her designee of the applicant\'s intent to drive a vehicle upon the beach for the sole purpose of cutting or collecting firewood or driftwood and

4.   The applicant present evidence of financial responsibility showing that the applicant has the minimum required limits of automobile insurance as set forth in Section 16056 of the California Vehicle Code or otherwise satisfies the financial responsibility requirements of the California Vehicle Code.

B.   A separate permit must be obtained for each vehicle to be parked, driven,  operated or controlled by the applicant on North Beach or South Beach.

C.   Permits shall be displayed in the lower left windshield of the vehicle during all times the vehicle is on North Beach or South Beach.

D.   Those persons who have obtained a permit pursuant to subsection (A)(1) of this section are prohibited from driving, parking or operating any motor vehicle upon, along or across North Beach or South Beach unless they have in their possession and are using fishing gear normally used for sports fishing license or normally used in the commercial fishing license.

E.   Those persons who have obtained a permit pursuant to subsection (A)(2) of this section are prohibited from driving, parking or operating any motor vehicle upon, along, or across North Beach or South Beach unless accompanied by the person suffering the disability which entitled them to issuance of a permit.

F.   Those persons who have obtained a permit pursuant to subsection (A)(3) of this section are prohibited from driving, parking or operating any motor vehicle upon, along, or across North Beach or South Beach unless they have in their possession and are using equipment and gear normally used for the purpose of cutting or collecting firewood or driftwood. As to South Beach, such activities may take place only during the months of December, January and February.  As to North Beach, such activities may take place year round.

G.   Permits issued pursuant to Sections 10.16.070 through 10.16.130 shall be effective for one year from April 1st through March 31st. The County Administrative Officer or his or her designee shall not issue a permit until the applicant has paid a fee as set forth in the County\'s Master Fee Ordinance for each permit issued, regardless of when the permit is issued during the permit year.  A person who is qualified to receive and has applied for a permit pursuant to more than one provision of Section 10.16.100(A), shall not be required to pay more than one ten dollar fee.  However, separate permits are required for South Beach and North Beach.

H.   Any person who has applied for and been denied a permit may appeal the decision of the County Administrative Officer or his or her designee to deny the permit to the Board of Supervisors. Such an appeal shall be in writing. The appeal will be considered by the Board of Supervisors at the next regularly scheduled meeting for which an agenda has not been prepared at the time the appeal is filed.

I.   A separate permit must be obtained from the Redwood National and State Parks for that portion of the beach identified as extending from the park boundary south to cliffs below Crescent Beach Overlook.

J.   Access to North Beach from Pebble Beach Drive (aka Radio Road) across the land at Point Saint George is limited to the existing gravel road from the parking lot directly to North Beach.

K.   In addition to the permit fee specified in Subdivision G above, permit holders for access to North Beach shall also pay a refundable key deposit of $40.00 (Forty dollars and no cents).
