Section: 80 - Term Limits

Section 1. Term Limits. No person may serve as such for more than three total terms. It shall be of no consequence whether the terms are consecutive. Any person, whether by appointment or election, who serves a partial term in excess of two (2) years shall be deemed to have served one full term. This chapter will apply prospectively. Therefore, current supervisors can continue to run for re-election and hold seats on the Board of Supervisors as long as voters re-elect them. Term limits shall apply to new supervisors who commence a term of office after January 1, 2019.

Section 2. Severability. The provisions of this ordinance are severable. If any provision of this ordinance is held invalid, that invalidity shall not affect other provisions that can be given effect without the invalid provision.

Section 3. Conflicting Initiatives. In the event that this ordinance and another measure or initiative limiting or changing the number of terms a person may serve in office on the Board of Supervisors shall appear on the same election ballot, the provision of the other measure or initiative shall be deemed in conflict with this ordinance, and in the event this ordinance receives a greater number of affirmative votes, the provisions of this ordinance shall prevail in its entirety, and the other measure shall be void.

Section 4. Certification. This ordinance shall not become operative until certification of an affirmative majority vote at the June 5, 2018 Statewide General Election.
